No Gratuiity as per Employment Contract or only after 2 years?

As the Labour Law of Oman in private sector, there are certain rights which are infallible. It means even if employee signs an employment agreement not to receive those rights, still the employee is entitled to receive those rights. The employer is also barred from using the employment agreement to deny those rights for the employees.

One of those rights is end of service benefits or gratuity. yes, there  is condition to fulfill for the employee to be entitled to receive gratuity, that is completion of one year with the employer provided the employee is not terminated under Article 40 of the Labour Law.

Thus, as long as an employee completes one year of service, he or she is entitled to receive gratuity irrespective of what he agreed in his or her employment agreement. Even if the employee agreed not to receive gratuity or agreed to receive it after 2 years only, he/she will certainly receive it after 1 year according to the calculations based on the number of years of employment.
