Yes.  But I don't know how they'd enforce it unless you were randomly checked.

They know which passports cross which borders when (even based on ticket sales) and, no surprise, they know where you live.


They can also ban you for years without even knowing where you live, many stories of this happening.


That said, anecdotally, the system will only exist end of 2023 and now its up to the border crossing guards when you leave the area to check stamps.

I travel a lot inside Schengen (short trips) and also from UK to Schengen and what I've noted is they no longer stamp my passport. And for travel within Schengen they don't check anything, but I guess they might know from the flight ticket data as you say.

I've spoken with British and Latvian consulates last few days and honestly no-one has a clue, they dont understand the 90/180 rule and no-one has any clue what the rules are for an article 50 residence holder traveling with their EU spouse (supposed to have identical rights, no-one knows for sure, especially when the EU spouse is traveling back to their own country).


I was planning to stay more than 90 days out this summer but probably going to just play it safe since there just doesnt seem to be anyone who understands it at the embassies - I cant imagine the confusion at border control.

this isn't even remotely true. Your Maltese residence does not give you a out from the 90/180 rule in other countries as a non eu citizen

Exactly the UK has lost the freedom of movement.

They don't anymore but its still up to the country if they choose to. It doesn't matter if they do stamp providing you hold an Article 50 card. The whole point of the digital scan is for frequent travellers and that stamps don't fill up the passport so they need to get a new passport all the time.


I would be careful with what the Local says, it needs to be corrected many times. Gov.uk website posts more up to date advise.

Correct, the same is applicable in Malta. My wife who is not an EU resident and I travelled many times between Malta, Italy, Austria and Germany by car and her passport was never stamped.

Nobody checked the length of our stay in any of these countries.
