Woman ordered to repay employer after software shows ‘time theft'

A Canadian woman has been ordered by a civil to compensate her former employer for “time theft” after she was caught misrepresenting hours worked by controversial tracking software.

Karlee Besse, who worked remotely as an accountant in British Columbia, initially claimed she was fired from her job without cause last year and sought C$5,000 ($3,729; £3,066) in compensation – both in unpaid wages and severance.

But the company, Reach CPA, told the tribunal Beese had logged more than 50 hours that “did not appear to have spent on work-related tasks”.

Reach said it installed employee-tracking software called TimeCampon Besse's work laptop after it found her assigned files were over budget and behind schedule, a strategy companies are increasingly taking in the era of remote work.

The software tracks how long a document is open, how the employee uses the document and logs the time as work.

Weeks later, the company said an analysis “identified irregularities between her timesheets and the software usage logs”.

While Besse told the tribunal she found the program “difficult” and worried it didn't differentiate between work and personal use, the company demonstrated how TimeCamp automatically makes those distinctions, separating time logs for work from activities such as using the laptop to stream movies and television shows.

Besse said she had printed documents to work on, but did not tell Reach she was using hard copy because she “knew they wouldn't want to hear that” and she was afraid of repercussions.

The company said that the software also tracks printing – and that few documents had been logged as printed. It also said any work from the printed documents would have needed to be input into the company's software, which never happened.

According to a video meeting between Besse and the company when they confronted her with the discrepancies, she told her manager “you can't fight the time”, admitting she had “plugged time to files that I didn't touch and that wasn't right or appropriate in any way or fashion … and so for that I'm really sorry”.

The judge tossed out Besse's claim of wrongful termination and ordered her to pay C$2,459.89, both in returned wages and as a part of previous advance she had received from the company.

Thrilling P1, what's that got to do with this "Philippines Expat Site?"

`

Was expecting the question and fair enough. But many folks here

may also work online, or are planning to in the Philippines maybe.

A major Phils income earner, any interesting stories or advice ppl?

`

Canadian news here?

Cheers, Steve.

Mate, online, it's world wide news. But, whatever.

Anyway, home-based call-centre jobs seem available

Post relative topics to the Philippines, not crap like the turtle doves coming back to UK Or some poor woman that felt victimized in a different country. This is a Philippines expat site, news around the world no mater how insignificant, post it on the appropriate site and enjoy.

Cheers, Steve.

Perhaps the question is "How many online workers in the Philippines are accountants?"  Guessing very few expat accountants working online here.

`

Regarding Expats enjoying life in the Phils, we shouldn't forget working online.

For eg, a lot of American people are now working from where-ever they choose ..

"A recent analysis of U.S. Census Bureau data found that 29 percent of Americans were working from home in October 2022. NYC financial firms reported that only 56 percent of their employees were in the office on a typical day in September 2022. A recent paper from the National Bureau of Economic Research estimated that 30 percent of all full-time workdays would be performed remotely by 2023."

"Across the U.S. nation as a whole, about 47 % of offices are currently occupied."

Ref: https://nymag.com/intelligencer/2022/12 … ities.html

And Phils folk themselves have certainly moved to working from home in a big way.

Our nephew on Palawan works for a U.S. investment company and doing very well.

Our Phils family, all School / Uni teachers, have spent 2+ years working from home.

As did nearly every teacher employed in the Philippines.

Working from elsewhere is an un-stoppable world trend.

With some smarts, we Expats can do the same if we want?

Right now, many U.S. companies are desperate for workers.

Why not pull some strings, talk to them, arrange some hours?

Then pack your bags and head for these beautiful tropical isles.

Must say if you do, suggest you don't try robbing your employers. 1f600.svg

And after Guest 6851's post even fewer 1f923.svg

@PalawOne And don't forget to 1. Get a visa that permits work and 2. get a tax number from the BIR.  Tourist visas do not allow work. 13A and SRRV do allow work.

Getting back to the basic premise of white collar online workers. The majority of online work began with Covid-19 and lock downs.

Fast forward to lifting of Covid restrictions, many firms wanted these white collar workers to return to the office, some companies were not asking much, maybe even returning several days a week.

Like anything else in life, many of these original Covid online workers snubbed their employers, resisting the idea of reporting in person to the office. For many of them this was a gift of being paid by a generous and understanding company by allowing them to work from home online.

I really don't think continuing this practice is very efficient, as there is so much room for abuse.

Abuse is more likely without supervision or big brother looking over your shoulder. There are cheaters even when being supervised, the unsupervised wonder how their bosses can be so stupid without checks & balances.

Another previous poster said to the OP what does that have to do with this Expat site?

What it does have to do with this Expat site is there are people on this site who make a supplemental living being employed online and also others thinking about moving here if they could work online.

That cant be a problem by how I lead people  :)  by I have the approach pay people based on how much they GET DONE, UNDEPENDING of how many/few hours they needed to do it...

That also make the bad ones clean out themselves by they earn bad   :)   and the good ones earn good.

Sometimes they earned a percentage of what my business earned at the project they were involved in.

When possible, which have been the normal,  I have charged clients similar to such thinking  too,

Predecided static payment to do a specific work for them,

or geting a percentage of the improved result they got by what my business did for them.

Coach, do you have online workers?

50 hours is a lot but in what time period. I used to have a job as an Environmental Officer with the local Council. I would say the job was split 50/50 regarding hours spent outside the office and inside.

These are some of the things people I worked with including Managers and myself did which are not work related.

Visit the shops to buy dinner, bread, milk, etc.

Visit the Pharmacy.

Take the car to the garage for MOT or minor repairs. (This one could be deemed to be work related as a car was necessary for the job to visit different sites and one needed Business Insurance).

Go to the Bank.

Print documents using the office computer and printer - Flight bookings, concert bookings, etc.

Check train/ bus times.

Read reviews for restaurants, hotels, etc.

I have know people even to book flights and holiday at work using the work PC.

But the one thing that really got on my nerves was when people who were on maternity leave brought their new born baby into the office. They would be there for the best part of an hour with a lot of the staff, managers included making stupid baby faces and chatting about the birth, the baby while others were trying to concentrate and do their jobs.

If there is anybody on this forum who can say with honesty that they have not done one or more of these things or similar, I would be amazed.

I think the issue with the lady mentioned was that she did it to excess and she had software installed on her PC which monitored her work. Maybe she should have just used her own personal PC instead to do the unrelated work stuff and that way the company would be non the wiser.

Reminds me when I was in college. . . .I worked part time at a medium size office (medium size. . . covered one floor). On Saturdays I had to pick up the mail at the post office, I soon learned if I picked up the mail at 6 am, there was less mail, to be sorted.

I could get the job done in two hours instead of four hours for a full mail load. I marked my time card for four hours. One Saturday another employee showed up at the office, after a couple hours he said the boss sent him in to check on me and really didn't want to hang around any longer. So we both agreed that we came in at 8 am and left at noon, so then he left. I waited around for another half hour to make sure and then left.

Another story. . . .When I moved to Las Vegas, my employer had a woman the manager and her office was on the second floor. One evening one of the dispatchers was watch porn on his computer. Well when she came in the next morning she booted up her computer and up came the Porn site.

He was fired and gone before I reported to work. Incidentally I had a company car and unknown to me she put a device on the vehicle to register the use (mileage, speed & time). The speed limit on the freeway was 65 mph, I got called in her office for driving at 67 mph.

I worked with a guy who had a company van. One evening after work he drove it to the outskirts of Leeds to watch Leeds Rhinos play a rugby match

Coach, do you have online workers?
-@danfinn

Had earlier when we developed PC program for a client.  It was back before I started researching Phils.  They were spread in the world USA, UK, Russia, Pakistan beside Sweden.  Led them with my English inspite of some claim its terrible 1f923.svg    Had only one missunderstanding in several years, but it wasnt because of language, it was because one thought first layers from bottom and other thought the one at top first seen, so it became confusing conversation  :) until I found out it was opposite thinking.

If not counting the acountant, which is partly through internet. Dont have any in the two businesses I have now in Phils and my business in Sweden is kind of closing, dont trying to get any new clients, no employees anymore in Sweden. The small need we have yet in Phils I handle myself, but will perhaps add one later if I dont handle it myself too when we will need more.

Why?

Reminds me when I was in college. . . .I worked part time at a medium size office (medium size. . . covered one floor). On Saturdays I had to pick up the mail at the post office, I soon learned if I picked up the mail at 6 am, there was less mail, to be sorted.

So you were a liar back then too...  :D

But didnt you get the later arriving mails the day after by doing like that?  If so it was making things INeffective for the company WITHOUT you gained anything  1f923.svg

(During I worked extra parallell to high school, I did kind of opposite to you, made things much more effective than the normal. At least 1.5 times faster when I did lead groups,  when it was only myself most common I were 3 times faster than average of the others and once even  almost 5 times faster by I had learned to not listen to a stupid boss concerning how to do things :)  I stoped listen when he had told what to become.  This made they offered me the Planning boss work direct after High school WITHOUT I applied...)

But I dont mind paying people for expected time needed undepending of if they can do it correct in much shorter time. When possible I have paid a predeciced amount for a work, which made some earned good and some earned terrible so the workers sorted away themselves by they quit   :)

A few days ago the team asked for predecided pay for constructing the manufactory, but problem to tell by I dont know how long time some things need and I dont want to pay to much neither to litle so they can become grumpy  :)   So we will discus step by step and some will be time and some will be for done part.

@coach53 Why? Because you seemed to be giving advice to online workers based on your stated employment of construction laborers. But now I see you have employed both. Thanks for your response. Having said that, i reserve the right to respond to future narcissistic posts 😂😂😂

:)

I see.

I have basic knowledge for "all" types of businesses  :)  - except I am bad at most types of being seller, because I find most very booooring.

Most of main business things are basicly the same to lead anyway and much can be solved by logic thinking   :)    Its common big companies are lead by economists and/or "people handlers" WITHOUT any detail knowledge for that business type.  Have done business consultant assignments since around 1980, normaly only charging a percentage of improved results they got by my changes, which normaly have cost nothing/litle.   (Done in such business types as distribution, production, health, software, education...) If having skill for it, can errors/improvements be seen soon and then think how to solve it.

E g the business I started first in Phils, I HADNT planned to start, but I happened to see there are many such much wrong handled, but rather easy to correct, for sale for much less than the value, which made I chosed to start such, buying to correct the errors.

You have missunderstood some things:

In the age when boys try to bragg and up to age when I started leading a sport club I NEVER said anything positive about myself  (inspite of I did many good results within both school, sports and work.)   But then I changed how I talked to

get free PR for the club in both local broadcasting and newspapers, when it was in second bottom league when I started, to get many more kids to join the in start tiny club.  First we had problem to become interviewed but when finaly got one, I had prepared what and how to say things journalists want to hear, so after that THEY called to get interviews   1f923.svg

(E g instead of saying boring things as "We aim at become better"   :)   I said things as  "We will climb to second highest league"   and "We will become among the top 10 youth clubs in the country."

I said such things at the yearly members meeting too, trying to get permit to spend money at reaching what I said. Almost all found my goals laughable and impossible and said NO - until I said I personaly guaranteed the club will not lose money, then they finaly agreed.

A few months later I had made the youth team second best in the region. Then came one of them, who had found my goals most laughable, and said:

-From now on I believe anything you say.

Many trainers are better than I at exersising players, but I made so we reached top results by making the players to become many and BELIEVE "impossible" can be possible.

(Btw we reached higher than the laughable goals   :)   I had said. The senior team reached the top league and the youth became second best in the country.)

Similar when I talk about starting business in Phils inspite of many say its impossible to succeed, I talk about it to INSPIRE people to try, showing its possible...

(And mensioning what I have done to give credibility to what I say by I have done "impossible" things before within businesses too. E g I started my business with only 2000 usd and did grow it to 70 employees regularly and 115 at top months.  Some more talk needed at internet though by IRL people can see what I have done...)

When not to promote the sport clubs I still DIDNT say any positive about myself though. E g when girls/women have asked at dances-What do you work with?

Then I just said "Distribution" as if I were mailman or such, NOT telling I were the owner of the business  :)

"Narcisist believe he is better than he is."

Well.  Thats not suiting defintion about me by I have DONE more than one "impossible" thing  haha
