how to get german citizenship ???

hello!
i'm a filipina married to a german national.
we are married for 2 months now.
before you think negative about me, i signed an agreement with my husband before we got married, stating that i will not get anything, anything at all from him when the time comes that we get divorced.
that is perfectly fine with me since i truly love him.

most people in the philippines think that i am now a german citizen since i am married to a german.
i am not really knowledgeable about this so i need your help or advice on this.
even i dont know about citizenship, i don't agree that i am now a german citizen.
i still hold a filipino passport and i have no idea how to get a german passport.
this thought made me join this forum, along with the thought that my husband doesn't want me to be a german citizen anyway, for whatever reason, i have no idea.

i am not being opportunistic, i just don't want to be ignorant about this process of being a german citizen.

i want to know how people in my case, a non-german married to a german national, can get a german citizenship?
what is the process?
what are the requirements? (concerning being married)
how long does it take?
i would really appreciate any sincere response and help.

Hello,

I'm a German citizens and after my knowledge you are able to get a german citizenship since you are married to a German. You should visit the nearest "Einwanderungsbehoerde" or "Einwohnermeldeamt" and get a consultation there.

In case your German isn't very good yet you should take your husband with you? You should also bring your passport, your birthcertificate and proof of your marriage.

That's as much as I know. Sorry that I cant help you more but try to get in contact with German authoritys or maybe even the consulate.

I am an american citizen and have moved here because of my fiance. I would like to stay in germany for good, but i wanna do it a way were i dont have to get married to to it. Hey USAGermany,

I am very familiar with your situation since my boyfriend, who is Australian wants to come with me to Germany and live there forever.
I have searched the Internet for advice but the only solution I've found so far is trying to get a job in Germany. To be able to work you need a working permit, which you can get from the American consulate in Berlin (?). After 8 years of legally living in Germany you are allowed to become a German citizen.

Sorry, that I can't help you more. Maybe you are able to find some more information via Google or check out the Guide here if you haven't already done that. I found some very useful information there.

I hope that someone else will reply to your question with more possibilities than I could give you.

Hallo every one,

My situation is a bit different but at the end it is also about to get a German citizens (but actually the final purpose is to get a work permit).

Just describe my self abit: I came here with a student visa because I planned to do my Master Degree. Recently I changed my plan, which is to look for a job instead of doing the Master Degree. Surprisingly my plan to look for a job is also not working because we just had a great news that I am pregnant (with my German boyfriend) for 3 months (Twins :-). So, my plan is now again changing, I would like to look for a job one year after giving birth. But my problem is that I have student visa, which is not allowed me to work full time. So my concern is, whether I can get a work permit after giving birth without marriage (because we plan to do it when our children are abit older)?

Could any one please advise or share experience?

Another point is that I and my boyfriend are not living together (sadly we had recently problem - I do hope that it will be worked out soon), is there obligations or supports that my boyfriend should provide me legally in financial regard in case we have a break-up?

Hello Jen,

I am also a Filipina married to a German for over 3 years now but been living here in Germany for 2 and a half years. At the moment Im holding a 3 years visa: this means that my stay here in Germany is depending on my marriage to my husband. By May 2011, my visa is due for renewal, hopefully for "unlimited visa". This means that as long as I am living here in Germany, there is no more expiration.

The requirements for german citizenship are:
1. Zertifikat Deutsch = B1
2. Einbürgerungstest = citizenship exam


You are new here in Germany, only 2 months married, first you have to attend the Integration Course (German Language Course). This requires 600 hrs and after this you ahve to take and pass the B1 exam.

Then once you have this B1 certificate (Zertifikat Deutsch) you can register yourself in a Volkhochschule near you who is giving "Einbürgerungstest". However, even if you pass this citizenship exam, this doesnt mean that you are qualified for citizenship.

You have to complete the 3 years here in Germany and you have to have the unlimited visa status first before you can apply. Unlimited visa status means your stay here in Germany is not depending on your marriage to your husband. And I was told by a friend, that the processing takes time..

I will apply german citizenship next year..so I will let you know.

Its a pity that you signed a prenuptial agreement, however, for your information, all the property that he or you produced within your marriage, you have the legal right on that. He has to provide you health insurance and of course being his wife, you have the right on his pension when he died.

Get in touch with Auslanderbehörde(Aliens Office) near you.

Thank you for yout reply. I spoke with my girlfriend about the visa. She is still daubtful for success to get a visa, but i told gher from this platform.

Now i look for phillippine people here in my hometown Dresden for friensship for her in case of sucess with her visa.

Hi Jen, if he loves you, he would want a German citizenship for his wife. Your husband sounds like he wants to deny your rights as an independent person here; you must protect your rights. It's not practical that you're totally dependent on him. And you must register in Volkshochschule for proper Deutsch course from different levels, for integration and citizenship purposes. I would suggest you contact A Filipino Pastor and wife at jfap.de  - Pastor Tony und Sarah Ibarra from Jesus for all People Church in Ludwigshafen, on their website or to call them.

Secondly, please contact either the Protestant org Diakonie at diakonie.de or Catholic org at Caritas at caritas.de . Diakonie is better for advise including legal advise and it has usually women's group. But both are also opened to non-Christians and has branches everywhere. If you want to be independent, try to go yourself or join their women's group.

Jen, I hope you will meet other nice women, thus ask Pastor Tony there for a good church in English near your place. There you can meet other Filipino ladies or from other ethnic groups. I met some migrant women whose husbands won't even allow them to church; because they don't want the wives to be independent and meet other people. But if you're not a Christian, you can meet other women in women's group in Diakonie where many members are also non-Christians.

Prussia's nationality law can be traced back to the "Law Respecting the Acquisition and Loss of the Quality as a Prussian subject, and his Admission to Foreign Citizenship" of 31 December 1842, which introduced Jus sanguinis to the country. Until 1913, however, each German state had its own nationality laws, those of the southern ones (notably Bavaria) being quite liberal. In 1913, the Nationality Law of the German Empire and States (RuStAG) of 22 July 1913 standardized the law in all of the German Empire. It had been operational until the 1999 reforms.[2]

Under the Third Reich, German nationality law was extended to Austria in 1938 under the Anschluss which annexed Austria to Germany. On 27 April 1945 the Republic of Austria was re-established and conferred Austrian citizenship on all persons who would have been Austrian on that date had the former (pre-1938) nationality law of Austria remained in force. Such persons lost their German nationality automatically. Also see Austrian nationality law.
Children born on or after 1 January 2000 to non-German parents acquire German citizenship at birth if at least one parent:has a permanent residence permit (and has had this status for at least three years); and has been residing in Germany for at least eight years.Such children will be required to apply successfully to retain German citizenship by the age of 23. Assuming the laws are not changed prior to 2023, they will normally be required to prove they do not hold any foreign citizenship.

A person born of a parent with German citizenship at the time of the child's birth is a German citizen. Place of birth is not a factor in citizenship determination based on parentage.

Those born after 1 January 1975 are Germans if the mother or father is a German citizen.
Those born before 1 January 1975 could normally only claim German citizenship from the father and not the mother. Exceptions included cases where the parents were unmarried (in which case German mothers could pass on citizenship) or where the German mother applied for the child to be registered as German on or before 31 December 1977.
Special rules exist for those born before 1 July 1993 if only the father is German and is not married to the mother. The father must acknowledge paternity before the child is 23, or acknowledge paternity and marry the mother and the child must declare himself or herself to be a German citizen.
A child born in a foreign country will no longer receive German citizenship automatically by birth, if his/her German parent was born after 31 December 1999 in a foreign country and has his/her primary residence there. Exceptions are:
The child would be stateless.
The German parent registers the child's birth within one year of birth to the responsible German agency abroad.
In case both parents are German citizens, German citizenship will not be passed on automatically, if both parents were born abroad after 31 December 1999 and have their primary residence outside of Germany. Exceptions are same as the above.
Those born in Germany and adopted to a foreign country would need to contact their local German Consulate for clarification of German citizenship.
Persons who are Germans on the basis of descent from a German parent do not have to apply to retain German citizenship by age 23. If they acquire another citizenship at birth, they can usually continue to hold this

A child adopted by a German citizen becomes German national automatically if aged less than 18 on the date the application for adoption was made. So dual citizenship is granted.

German citizenship may be acquired by naturalisation by those with permanent residence who have lived in Germany for 8 years. Additional requirements include an adequate command of the German language and an ability to be self-supporting without recourse to welfare.

Applicants for naturalisation are normally expected to prove they have renounced their existing nationality, or will lose this automatically upon naturalisation. An exception applies to those unable to give up their nationality easily (such as refugees). A further exception applies to citizens of Switzerland and the European Union member states that do not require Germans to renounce citizenship upon naturalisation in that country.

Exceptions to the normal residence requirements include:

A spouse of a German citizen may be naturalised after 3 years residence in Germany. The marriage must have persisted for at least 2 years.persons who have completed an integration course may have the residence requirement reduced to 7 years
refugees and stateless persons may be able to apply after 6 years residencepersons who have studied in Germany university may have the residence requirement reduced to 6 year without requirement of any integration courses.former German citizens

Parents who are citizens of European Economic Area states or Switzerland are eligible to receive permanent resident permits after five years.

How to become a German
German citizenship can only be applied for after a number of years. To become a German citizen, you generally have to be resident in Germany for 8 years and fulfil certain conditions.

In most cases, you have to fullfill most or all of the following conditions:

a valid Aufenthaltserlaubnis or Aufenthaltsberechtigung residency permit

legally resident in Germany for at least 8 years

a livelihood-guarantee of you and your dependants without recourse to social welfare or unemployment benefits (exceptions are made for people under of 23 years)

adequate knowledge of the German language

on oath on the German constitutionein

you have to give up your former citizenship (although there are exceptions to this)

Spouses and children can often be naturalised even if they have not been living in Germany for 8 years. For spouses of German citizens the couple must be married for two years and the spouse resident in Germany for three years before the application can be made.

A brochure entitled Wie werde ich Deutscher (How can I become a German) gives advice on becoming a German citizen. It is available from the Beauftragten der Bundesregierung für Migration, Flüchtlinge und Integration and at www.einbuergerung.de.

Children: German Citizenship by Birth
German citizenship is determined by inheritance from parents and not by place of birth. Children with a German mother or father are automatically citizens at birth. But not all children born in Germany are automatically German, in fact, there are 100.000 non-German children born every year.

If both parents are foreigners then the child only gets German citizenship automatically from birth if one or more of the parents has been legally living in Germany for a period of 8 years and has a valid Aufenthaltsberechtigung or has had an unbefristete Aufenthaltserlaubnis for a period of three years. Hi i am very new here. and i send a private message to princess, im sorry for that, too late for me to see that there is a box here below smile) but yes i agree to what princess said. I'm from Romania and i'm living/working in Germany.
I want to ask if i can get the german citizenship by the fallowing description.
My grandgrandparents were german citizens and german nationality.As some of you know in the past traveling/living between Prusia(Germany today) and the Austro-Hungaryan(A-H) empire was alowed.My ancestors decide to move in the easter region of the A-H empire (Transylvania,Romania today).
After the end of the WW2 my grandmother has 6 years and  she also have german citizenship and  german nationality.The comunist regim that came in Romania  after WW2 forced all foreign citizens who want to stay in Romania to give up their citizenship and they nationality.My ancestors refuse to do that and they whent deported to make force laibor in Romania and the ex USSR.
After a period of deportation and force labor they give up to their nationality and citizenship and they became romanians by force.
I have all the papers to prove what i describe above and my question is if i can get german citizenship?

Hello Lucky13,

I do think, that it is possible to get a german citizenship, since your grandparents were German. But I do think, that you have to meet some requirements, such as speaking the German language, having a full time job and enough income and you probably have to do the "Einbürgerungstest".

Since Im not 100% certain, I advise you to go to your nearest alienoffice (Ausländeramt) and talk to them about it, since they know all the rules.

I have a full time job,i nderstand german language(70%) and i can speak it like 30%.
In the fallowings days i will go to Ausländeramt to recive more info.

Hello...
My husband was born in Canada just before 1975. His mother is German and lives in Germany, but my husband cannot get German citizenship because Germany does not allow maternal citizenship to be passed on if he was born before 1975.

My husband does not have any family in Canada (his entire mother's side of the family lives in Germany) and desperately wants to move to Germany/become German, but cannot. Does anyone know of any exception that would allow his to gain citizenship?

Hello Angelful,

sadly it is very hard to acquire a German citizenship without having german family or in your case being born before 1975.

The only way I can think of is for him to get a full time job in Germany. He definitely should take german clases, if he doesn´t already know it through his mother. Because you can`t live or work in Germany without speaking the language.

I´m sorry that I can´t be more of a help but this is all I know.

Sadly I do not know companies like that. I do know, that Germany needs well trained people, but I have no idea where he could apply to get a job here. Try searching the internet for global oder international work agencies, that is the only thing I can think of at the moment or maybe ask at the German ambassy in Canada.

Dear people,

Hi I am Engel Schwandner. My father is a German citizen and my mother is a Filipino citizen, they are married for about 20 years here in the Philippines. My father died 9 years ago.
When my father was still alive, he planned to make his children German citizens; however it was not pursued due to his death. I am half German by blood, but I do not speak Deutsch; but I am now attending basic German language classes. We also receive monthly financial aid from the German government for our schooling here.
I also have relatives there in Germany but we lost contact since my father was permanently residing here in the Philippines.
Can you please tell me what are my chances for German Citizenship. What should I do to apply? I also want to go there to apply for a job. What are the odds of finding one?

hello to all, i am a 50 years old englishman who was adopted at birth in Sunderland uk  by my  my german mother and english father,my mother had moved to England in 1951 and married my father, they lived from 1951 in England but my mother is originally from Braunschweig , i have visited Germany many times and can speak the language, i am interested in duel nationality, is it possible for me ?,thankyou .

hello everyone and to all messager here at www.expat blog  , Im glad to hear from you . as from now , im still confusing all of  my question that i need and answer .. And its nice to hear from you all . Im a filipino and 19 yrs young . and what my question is  My VIsa is Lebenspartnerchaft or it means( Fiancee Visa) just arrive lat sept 14 here in germany ..Im a man wanted to married with  a man also . ..
If we get married the  in several months i wanted to go back in philippines because of the weather that sometimes i feel not so good at this time of winter , and maybe will go back again in germany   in summer time , So is it possible that i can get back easily  here in germany again ?

hello i am from Pakistan and i plan to come to germany for higher studies and side by side i intend to do a work there will i need a work permit to do work or my student visa will be enough for this purpose and if i have some money to invest in a small business like to rent a shop can i do this without the work permit with my student visa?

As a student you are only allowed to work a very limited number of days per year. I believe you can work 90 days, or 180 half days.

i am not sure if you can invest in a company on a student visa. maybe someone else has an idea.

After marriage, you can apply for the Aufenthaltserlaubnis, which is valid for 3 years, and you can come in and out of Germany in 3 years without the hassle of filing for visa, however, the downside is that, it would be difficult for you to get the unlimited visa or citizenship.

Hi kris! I am also Filipina and we got married in the Philippines. Whether you'd get married there in the Philippines or here in Germany, the documents you need are just the same as well as the length of waiting for visa is almost just same probability. We did not have any pre-nuptial agreement because my husband said we don't need it because he intends that I am the last woman in his life. It all depends on you and your bf, whether here or there to get married and whether you'd have pre-nup agreement. As for citizenship, downside for Filipinas is that we'd have limited size of land to buy in the Philippines when we give up our nationality, and we also cannot start a business if we carry foreign passport, one of the few reasons why I am holding back from getting citizenship. The pro however of having German passport is that we can travel to lots of countries  without needing for visa.

i am bisma from pakistan. i am living in germany from 2 years.my husband is a german national. i wnt to get divorced while he is not sexually fit i mean i am still virgin after 2 years of my marriage.i am vry worried bcoz i dun wanna go back to pakistan.can any body help me in giving details for german nationality.i hv heared that i cn apply nationality after 2 years.is this true??? pls hep me

i need some information.please help me. my family is in german and im in pakistan. i have applied for german visa from dubai but they rejected. my brothers, sisters and father is in german. im alone here in pak and want to join my family. my mother has died, now im alone.my brothers aren't helping me for german visa. plz tell me how is it possible to get german visa. as my sisters are also in german. im 24 years old. can they invite me to german for long-term visa? plz tell me what is the whole process? sad

You have to apply for the visa at the German embassy in your country of residence. Applying in Dubai while living in Pakistan won"t work (that's probably why your application was rejected).

plz tell me if i want to apply for german language visa. what will be the process? will german embassy accept my visa ? and i want to know about work visa for germany. what are the requirements for work visa. if a company offer me to work as a sales man in german then german embassy will accept my visa or not? can we apply for any type of work for german visa?

Hi Jen,
     I am also a Filipina married to a german and a got my German citizenship after five years of marriage. I never applied for Permanent Residence Permit before, but they still allow me to apply for the Citizenship since I have a child. I took the Integration course and got my B1 Certificate, then I also pass the Einbürgerungstest which is also an important requirement. For the Hausfrau or Housewife they will ask your husbands Income tax.

Requirements:
At least 3 years married ( living together)
Eight years living in Germany( Permanent  Residence Permit)
B1 Certificate Deutsch
Einburgerungstest
Income tax
Health Insurance

i believe, as you are married to a german,  you need at least 3 years until you could apply for german citizenship.
