My EOI Rejected

Hi,

I need your advice on below,

I have submitted the EOI and got selected from the pool(points 145) on October 31st 2012, unfortunately it went to UNSUCCESSFUL during preliminary  check.

When I called Immigration customer care yesterday (23/11/2012), they said

1) Institution name is not in the exempt list, I am from India(Tamil Nadu) I have done my bachelor of engineering in KONGU ENGINEERING COLLEGE affiliated to Anna University. They have ANNA UNIVERSITY in the exempt list. Instead of mentioning ANNA UNIVERSITY i have mentioned my college name which is KONGU ENGINEERING COLLEGE, due to this my points has come down.

I have college degree certificate provided by ANNA University which I can show as proof.

2) My points has come down again in my work experience, I have 5+ Years of IT experience in INDIA, where in there list INDIA is not a option, if the countries are not there in their list, they have a option like (Work experience undertaken in a country not listed at (a) above will be assessed as being in a comparable labour market only if it was undertaken for a multinational commercial entity)

I have worked in MNC India for all 5+ years , companies I have worked in INDIA are SYNTEL LTD, TATA CONSULTANCY SERVICES.

Without checking whether these companies are MNC or not, they simple reduced my points and marked my application as unsuccessful.

This is ridiculous, I have proof for all the points I have claimed.I think its their mistake they didnt validate my application properly

So can anyone advise, if I show them proof on my qualification and work experience, is there any chance they can reconsider my application? If not what should they do? I want to proper justice for my 510 NZD.

well, you can't. INDIA is not a comparable labour market so no points for india work experience & Any Indian education (BE, BSc) from Anna University or even IIT will be awarded only 10 points.

why didn't you assess your education by NZQA?

What research you did in the whole process of applying a Visa?

Even if we get NZQA also, after submission of ITA. They will make you wait as a process of 8 months and say. Your work experience is not under NZ labour level. And they will suggest you if u want u can get IPENZ assessment, with a quote they mention its fully on ur call!!! (IPENZ : 1400 NZ $ Approx.)

Because I'm in this stage now...for the past 1month. I dont know i have to go with IPENZ or drop my PR process in this stage itself.

It's really frustrating to see EOI "unsuccessful" after selection. Seems, we both are in the same boat. Significant changes on NZ immigration process and its been tougher then before. In my case they rejected because, my application looks suspicious of action having my Employment and education (despite of assessing NZQA in first stage as successful). Ridiculous isn't it ?
   But fact is somewhat different, NZ strictly discouraging to file immigration by "SELF" or by unauthorized consultants. Atleast this is true for Indian citizen. Despite of having credible information, if you haven't take authorized consultants for NZ immigration, your application more or less rejected. So people like Y-axis , Abhinav and Opelentus stopped for NZ filing as they see huge rejection rate.
However, there are selected consultants in  INDIA authorized and only 2 in South India (one each in Chennai and Hyderabad), I consulted them, but there are expensive (90K consultants fees), So i am taking their consultation after 3 months (need to save money now :) ). Browse thru NZ immigration website to get their details.

Well your right i also sailed in the wrong boat, "Opulentus hyderabad"

Actually in much case i have submitted my ITA docuement & waiting for the status of long term skill shortage/ or work visa.
But unfortunately, now they saying for fews year of my work experience is not matching with NZ labour level. And if they want to consider my work experience they want me to go for IPENZ (again they will do the same as NZQA).
I really dont know what to do.

They will not reconsider you e of I. Its your fault for making mistakes, you should have sought help to prevent the issues you have come across arising.  In addition MNC refers to MNC based in the West not Indian based MNC's

You should write a formal letter appealing the decision of the NZ Immigration Officer my friend. For my application, I was not able to encounter such problem. Fortunately for my documents submitted to INZ, they did not ask for any clarifications. My school where I graduated from was also on the list, which I was able to be considered.

I am not sure though If you can still appeal your case. The best of luck anyway!

Welcome to Expat.com. Could you please give us a little information about yourself, why you want to move to NZ, what sort of work you do, what qualifications and experience you have.

I would not recommend you use an immigration agent as they are expensive and there is no guarantee that you will get entry to NZ.
I suggest that you visit www.immigration.govt.nz  for all bias information and applications. This is the site that agents get all the paperwork and information from.

I have a NZQA assessment of Level 9. However, EOI is rejected saying my qualifications doesn't match the required qualifications

I just had my EOI rejected by EOI. The reasons are as follows:

Reason#1:
Qualifications and work experience in an area of absolute skills shortage
To qualify for bonus points in an area of absolute skill shortage you must meet the requirements of the Long Term Skills Shortage List (LTSSL) for that occupation. The LTSSL requirements for ICT Business Analyst (261111) are available here: Long Term Skills Shortage List.

As your qualification does not match any of the required qualifications for an ICT Business Analyst, you cannot be awarded these bonus points. For a qualification to be considered a match for one listed on the LTSSL, it must match in type, level, and specialisation. You have indicated that you hold a Bachelor of Commerce in Commerce and Accounting, thus it does not meet any of the specialisations on the list and bonus points cannot be awarded for a qualification or work experience in an Area of Absolute Skills Shortage.


I have a Master Degree as well. I am a MBA in IT which has been assessed Level 9 by NZQA. Instead of considering my Masters, why has someone considered my Bachelor's? MBA in IT, I am sure this qualifies under the LTSSL, under the heading ICT.


Reason #2:

2.       Work experience

To qualify for points under the Skilled Migrant Category, work experience must be recognised in one of the following three ways:
1. It is undertaken in a comparable labour market
2. It meets the requirements of the LTSSL and the applicant meets all LTSSL requirements
3. It is relevant to an offer of employment in New Zealand.

I have found a statement on the one of the links in the website which says:
"Work experience points may also be awarded for work experience in an area of absolute skills shortage, gained in any labour market. Applicants who do not have skilled employment or an offer of skilled employment in New Zealand, but who do have work experience in an area of absolute skills shortage gained in a non-comparable labour market, can claim points for work experience on their Expression of Interest."
Why are there contradictions in the statements??

hi your qualification does not match the prescriptive list. In order to have a job on the LSSL list you need to have he appropriate qualification to support it..which clearly you do not..your masters degree is irrelevant. As you do not have the job skills to match he LSSL because you do not have the right qualifications to support it, your work experience is not counted either as you were not employed in a western country or by a western company.
Your failing the E of I  has nothing to do with using an agent or not it has to do with not understanding the relevant law around he process..which is understandable as it is quite complex..
Hiring an immigration adviser will not help..this also applies too the other chap above..he will be wasting his money..unless of course they suggest changing the facts to suit the situation.

So basically if you wish to apply for Residence in NZ you will need a skilled job offer

we got a mail that our residence visa application declined.
Reason given: you did not demonstrate that you meet LTSSL requirements. you have been unsuccessful in obtaining the required documentation from IPENZ. you have not declared a qualification that matches one stated on LTSSL

immediately on writing to IPENZ  they accepted to review without any additional charges and asked to resubmit . we informed our CO about this immediately still he gave decision the very next day
the reason given to decline is no qualification matching LTSSL. ANZSCO recognised my husband's qualification and gave a code that is in LTSSL.
CO says case closed. please advise us what should be our further action as the appeal to tribunal is again very expensive.

IPT appeal will fail as well...only option is to resubmit E of I and if chosen provide correct documentation provided IPENZ assessment is positive

In Cases such as this. I would strongly advise getting a few "Letter Of Job Offer."
No matter how and what you submit, INZ will need to know that you can provide for yourself and NOT be a burden to taxpayer and govt.
You will need those Job Offers in writing and would also help to have them sponsor you. Now the other catch, this case has a twist, wife wanting to go with. Now there could be an issue there. The paperwork is for one single person, the wife in order to get residency will have to do the same paperwork and have the a score that is equal or better than husband. Plus sponsorship is NOT for both husband and wife, it is for that one person on the paperwork. If both parties make the journey INZ can and in most cases deny both from entry to New Zealand. Or they will accept person with paperwork approved and the other one will be on the next flight back to country of origin. New Zealand is trying to curb the overflow of migrants as most have done nothing for the country other than put a strain on their economy. They want to see proof that you can make it on your own or you will end up going back period.

please I need help.
My husband has submitted EOI few months ago and it was selected then an immigration officer was assigned for our case.
My husband is a security analyst and his qualification is Bachelor of communication and electronic Engineering Cairo university ... NZQA assessed him level 7 general.
The officer said that his qualifications is not an exact match to LTSSL and the officer wanted that NZQA asses him as Bachelor of Engineering so my husband contacted NZQA but they replied that they aren`t authoriesed any more to assess engineering and he has to assess his qualifications with IPENZ , then he contacted IPENZ and explained his case to them and they replied that they can assess his qualifications and successful outcome guarantee him ponus points and he don`t need membership at this time. So my husband send this replies to the officer but he refused IPENZ assessment and claimed that their assessment will only give him the membership of IPENZ and his occupation is not an Engineer although my husband explained to him that according to raw 3 & 4 in LTTSL Telecommunication Engineering is an accepted qualification for security analysts.
Few days ago we were shocked that the officer declined our application after all this.

so please anyone can advise us about what we can do ? any idea about the appeal ? have we done anything wrong ?

please help.
