Transfer of Work Permit between schools .

I have had a work permit for 5 years that expires next month . I have just moved to a new school . What documents will my new school need to get me a work permit for their school? I have the still valid WP notarized by my old school . Has anyone done this recently ?

Hi,

It's expected that your new employer should know how to deal with that. Anyway, the process will be simple, no worry. Your new school will only need to submit your new contract and another request paper (signed and stamp by your new employer) to the Imm Office. You will get the new WP just after less than 1 week.

This a 2 yr old quote.
" It only _applies_ to your current employer. You can't transfer it, because it's specific to your current employer and current job.

Your new employer however can use your old work permit (or a copy thereof) to avoid some paperwork when they apply for a new work permit for you. Your old employer should then cancel the old work permit so the new Employer can replace it, if that doesn't happen automatically when you get a new work permit."

Pls keep us informed , ( I might be doing the same in the near future ), hopefully Virgoks is right, but that all seems too easy, and as anyone who has lived in VN for a while will know, if it sounds too easy , it definitely will be.

Hi Bill, please update your work permit status. How is everything?

I think other people should be updated about this case also. My last check with Labour authority on 11 October 2014 about his case is as follows: (provided that 1. he does not have a BA, 2. he has been living in Vietnam for a long time and does not want to provide police background from his home country again, and 3. he can provide confirmation on experience over five years from former employer and TESOL certificate)

"1.  You will apply for a new work permit as a education Specialist (which condition is BA or 5 years experience)

2. Foreign Police background check: you will submit a commitment that from the time you got your current work permit until now, you only residence in Vietnam, state your address.

You will need to apply for a Police background in Ho Chi Minh City

3.  Application dossier:

- Approval on the need of using foreigner for the new employer
- Application for issuance work permit
- Notarised copy of your TESOL certificate
- Original of Confirmation on experience on teaching english issued by former employee
- Police background check in Vietnam (Ho Chi Minh City)
- Commitment on residence in Vietnam (you commit, sign, and your employer confirm by signature and seal) (replacement for Police check oversea)
- Health check
- Current work permit
- 2 picture in 4x6
- Notarised copy of employer's business licence
- Authorisation for the person who go to submit the dossier (if any)"

From another check later, I think that you will not need to provide the experience confirmation from your former employer anymore, a copy of your 5 years work permit is sufficient to prove your experience on teaching English.

If you successfully submitted the dossier, or if you were required to provide any other document, please help let us know. Thanks

So what you are saying, is if you start with a new Employer, you need to go through the whole Work Permit process, I certainly hope this is not the case????( but we may have gone off Topic here? )
" 2. he has been living in Vietnam for a long time and does not want to provide police background from his home country again",
I think this is supposed to read, " does not NEED to provide a police background from his home country again?" as I didn't have to do with my recent application.
"   Commitment on residence in Vietnam ", how about rental contracts, etc.? ( proof of how long you have been here ), or are you talking about " committing " to how long you will actually stay, ( as in your Employment contract, max 2 yrs ).

Yes new employer = new work permit = start the whole new process.

He does not need to submit a police background from his home country anymore. Replace it by a commitment.

You show your wise when you raised this question. Yes the applicant better prepare some documents proving his resident in Vietnam for the whole five years. Though I usually see that only police department ask for residential document, but better prepare is only benefit.

This was exactly what I did, as a Director, for my employees. And it works. Dont try to make things even more complicated for our expats guys.

Added that, as long as your switch is within the same province/city, things will be simple that way.

" Yes new employer = new work permit = start the whole new process. ", but surely must be easier if you show them your old, ( and possibly, still current ),  Work permit?

But how can anyone prove they will stay here for 5 yrs, ( or do you mean the previous 5 yrs? " Residence " ), when an Employment contract is now only max 2 yrs, and once you receive your Work Permit, if you did have a 5 yr VEC, it becomes void, and has to be replaced with a TRC , which is for only as long as your Work Permit. ( 1 or 2 yrs ), I can see how the Govt will be making even more money from these Work Permit changes.
Do you sign a " Commitment " agreement, that's is in actually , only a written promise? ( which couldn't be kept , if something happened to the applicant, or the school ).
I realise somethings can be confused while being translated, you are doing a good job, so keep it up.

=> The work permit now only work as a Experience Confirmation. You can consider it as something "easier".

=> I meant the previous 5 years. This commitment replace for Police background check. Police background check provide his criminal history in the past only.
Since he has been living here for 5 years, he can only obtain a exactly the same police check as 5 years ago from his home country, which is have to be submitted before to apply for a WP. So it will be nonsense submitting it again. The labour authority recently have been receiving plenty of complaints regarding this issue, so a written commitment is kind of temporary method to deal with this problem. This practice may change soon and they may think about asking for other document to prove the applicant's residence status.
