URGENT ADVISE NEEDED!!!!!!!!!!! :-(

Hi everyone

I applied for my residency for NewZealand in June 2012 through short skilled category as i am working as a Retail Manager in telecommunication company. Now in Feb 2013 i have received a letter from my immigration officer saying that i cannot apply under short skilled category as there is some part of the requirement that i don't meet. they say i don't do :  branding, purchasing and marketing policies, setting prices and promotions

I don't understand why they are saying this as i am handling all the responsibilities of a retail manager. However, things like branding, purchasing and marketing policies, setting prices and promotions are set up by the company itself and sent to all the retail managers across.

Immigration wants to explain how i do this, but i dont do it as this is decided by the company operations team.

Can anyone please advise me how i can reply to this, as i don't want immigration to decline my application. i am really stressed :-(

It is now a crime in New Zealand to give immigration advice unless you are a trained and certified immigration specialist. As such, I doubt you will get any knowledgeable replies on an Internet forum. See:

If you are in New Zealand, there should be a community law centre near you that holds immigration clinics. You can receive general advice there, and, if you are extremely lucky, a lawyer might even take your case on a pro-bono basis.

NZ Immigration has new powers under the current government, and they are generally not accountable to anyone. See:

In the end, your best hope is to engage a qualified consultant or immigration lawyer, but don't expect them to sway NZIS one way or the other.

Hope this is not too late for you as I did not notice your post until now.

I am not an expert in immigration.  But it seems that it is unreasonable to expect someone to apply for immigration and be able to do all the other work which is usually determined by the senior management of the company.

Perhaps you have to do reasoning with them as I am not sure what is included in the official papers for your category.  If all fails I suggest you try the TV programme like Fair Go and they may be able to help you.  I believe that you have a good case.

they are saying it because management in the immigration sense is a strategic function, whereas when you are just working as a branch manager for a franchise, all the strategic function is removed, the businesss model is already established so you make no major decision, so your role is functional..and does not require technical or particilarly skilled..that's why..also retail manageer is not on any shortage list..you got that wrong

Thanks for the insight. I got shifted to Auckland a year before. I was likely to be known that some issues will arise on immigration, So I followed legal advice from [moderated], immigration lawyer, Auckland and thereafter I faced any hassle.

Please be careful what you say on these posts as they do look at this forum. I can assure you that they are not ignorant and they do know the difference between a job discription and performance plan. When applying for immigration you need to get confirmation of your role on a business letterhead as a starting point. Be very clear and honest too. Unfortunately many people come to NZ not well versed and prepared. Also there are a few who lie and minipulate the system. And just because you can get into NZ it does not necessary indicate "you are in". Because of safety measures, people who come here from high risk countries, which includes the Middle-East, some African countries need to "be very respectful of NZ and take care"....Big brother is everywhere.

Get the operational team to write an offical letter.
