Build a House or Villa in Bali

Easy - Foreigners can't own land in Indonesia.

Any 'scheme' that says you can, lies.
You can by an apartment or lease the land to build a house on but you can't own land.

That information now public, the OP can't advise foreigners how to buy property because it would be illegal.

The site clearly explains the position and mentions the possibility of the 'paper' owner selling it from under you.
It doesn't mention, if that happens, your chances of doing anything about it via the courts is around zero.

This is a very bad idea unless you like very risky investments.

Not to nit pick on you Elisa, but as Pak Fred says, it is a misnomer to use the word “own” or “freehold” when in fact the Hak Milik (land deed) will be in the name of an Indonesian citizen. 

Another problem that I see way too often is the bad advice to rely solely on a notaris for the legal work.  That is a bad idea.  A notaris cannot argue a case in the courts should a dispute or problem arise in the future.  It is far better for any foreigner engaging in any land development and lease contract on Bali to engage an attorney located within the specific regency where your home will located.

Also, and based on my own rather extensive experience building here on Bali, I find it much more preferable to work with local Balinese contractors and architects.  Simply put, nobody on Bali knows building on Bali better than the Balinese. 

Finally, it is essential to get the approval of the local banjar before starting any project.  It is in fact this last point where I see the vast majority of problems originating, and in the classic Balinese way, you won’t know about the problems until after your project is finished.  In my experience this is the most costly and frequent mistake that foreigners make here when building their “dream villa.”

it is ok, thanks very much Ubudian for your post, but yes I totally agree with what you said (actually we are a Balinese Contractor Company!)...so yes I know about the Banjar Relations and Permits very well since I have been involved in many construction projects and in many occasions I have seen really "bad decisions" taken by Villa Developers just by totally "ignoring" the Banjar or other community members...a really bad attitude! and of course many serious problems later on the way...
Just to clarify that my Company is not involved in the "legal" purchase of the land, this is usually handled by the clients with their Real State/Lawyer or Notaries etc...we are just contractors so we just offer some advice or information..that is it! What we really do for our clients is double check all those aspects involved when buying the land, mainly for construction purposes (land zoning, right of access, drainage, topography, boundaries etc...)...to make sure everything is under "green light"

Thanks for the clarification Elisa, which btw, sounds good to my ears! 

Far too many expats arrive here forgetting that they are guests in a foreign country and have the attitude or expectation that they can pretty much do what they want.  The Balinese, being Balinese, don’t do much to discourage that attitude, as that simply isn’t part of the Balinese culture or manner. 

Living in Bali for a foreigner is a privilege…it’s not a right, and starting off with that thought in mind goes a long way in avoiding serious and costly mistakes.
