Italian man wants to remarry

Ciao! I have this Italian friend, he was married in the Philippines last 2006 and it's been 3 yrs since he's been separated with his filipina wife. They were married in Manila and now he's in Italy and he wants to marry his italian girlfriend. Can he actually do that without divorcing his wife in the Philippines? Does the Italian law agree to that?

Re: Italian man wants to remarry

As an Italian citizen he should had his marriage certificate transcribed and validate by the local italian ''comune'' in which he is resident otherwise the weddings are not proven and he can marry his girlfriend in Italy but at his own risk, whenever someone for any reason would find and get the document transcribed, maybe his ex wife in philippines, he would be in trouble

Re: Italian man wants to remarry

He can't marry his Italian girlfriend without voiding his marriage contracted in the Philippines, whether he is already an Italian citizen or not.  He will still need to get the CENOMAR from our NSO which then will reflect his existing marriage.

Re: Italian man wants to remarry

Currently, according to Italian laws, Philippines is not one of those countries in which marriage is automatically validate unless it is celebrated at the Embassy, only Eu and a few of non-Eu countries are, so if an italian man marries a woman in one of those countries without an official validation by an italian officer, he is legally single (only in Italy of course) and he can legally marry anyone. As I said, this certificate does not expire so, let's say, in 10 years, if someone find and get the marriage certificate translated he will be in serious trouble 'cause polygamy is a crime here

Re: Italian man wants to remarry

Thank you for the replies/ comments. It is a civil and church wedding and it was translated and validated by the Italian embassy in Manila.
Thank you,Quennie and Cesar.
